USCIS Guidance Memo on H-1B Health Care Specialty Occupation

uscis-plain1In order to clear doubts regarding the standards for adjudicating H-1B petitions filed on behalf of beneficiaries seeking employment in a health care specialty occupation, the US Citizenship and Immigration Services (USCIS) Service Center Operations Chief, Barbara Q Velarde issued a memo to Service Center Directors. The memo avers Adjudicators to consult the US Bureau of Labor Statistics’ Occupational Outlook Handbook (OOH) to determine whether the position being offered qualifies as a specialty occupation under the Immigration and Nationality Act (INA) regulations. The memo illustrates various situations and suggests recourses and mandatory requirements the Adjudicators should take while adjudicating these applications.
