The Department of State (DOS) has issued an important notice regarding the procedural change for certain I-129F petitions for a nonimmigrant K-3 visa. The notice says that, “Effective February 1, 2010, when both the I-129F petition for a nonimmigrant K visa and the I-130 petition for an IR-1 (or CR-1) spouse of a U.S. citizen visa have been approved by USCIS and sent to the National Visa Center (NVC), the availability as well as the need for a nonimmigrant K-3 visa ends.”

The Department of State (DOS) released an annual report of immigrant visa applicants in the family and employment based preference categories that were registered at the National Visa Center (NVC) as of November 1, 2009. The report shows the number of immigrant visa applicants on the waiting list in the various preferences and subcategories subject to numerical limitation. All figures reflect persons registered under each respective numerical limitation, i.e., the totals represent not only principal applicants or petition beneficiaries, but their spouses and children entitled to derivative status under INA 203(d) as well.
