Hopeful announcement: FBI Background Check Delays May Soon End
November 29, 2007 – 6:06 pmILW.com has reported that FBI name check delays may soon not be an issue for I-485 applicants. The site claims that the executive branch is working on developing a new procedure, by prescribing a period of time after which USCIS will make a decision on the case regardless of whether the name check is complete. If FBI is not able to complete the name check process within the stipulated time frame (which as of now is unknown) they would continue processing the background check even after the USCIS approval. This means that the applicant would likely get a provisional Green Card, subject to denial if any disqualifying problems are revealed by the FBI during the background check. However, people should note that even this is somewhat of a speculation based on the internet posting.
