We are back…and so is common sense?
April 9, 2008 – 4:01 amDue to some recent traveling and international relocation, I have been unable to post since January. Beginning today I will have much more time to devote to immigrantdaily and will be frequently posting. As we return from our hiatus, it looks as though common sense may be returning to our policy makers as well. I am very excited to announce two wonderful updates to the U.S. immigration policy.
29-Month OPT for Certain Students
Finally USCIS has decided to fold under pressure and has introduced new proposed regulations expanding the Optional Practical Training Program to 29 months for students graduating with degrees in Science, Technology, Engineering or Mathematics.
Elimination of Cap-Gap Problem
USCIS has also taken a step towards getting rid of one of the most ridiculous problems in immigration law — the cap -gap problem which basically forced students to leave the U.S. for a month, even if they had a pending H-1 application. The new rule will extend the authorized period of stay for all studens with pending H-1 petitions and change of status requests. If USCIS approves the H-1 petition, the student will be able to remain legally in the U.S. until the start of his/her H-1 employment.
