CIS Ombudsman on “Motions to Reopen” Process and Customer Service

The Citizenship and Immigration Services (CIS) Ombudsman submitted certain recommendations on improving the filing and review process for motions to reopen and reconsider before U.S. Citizenship and Immigration Services. The Ombudsman opined that motions to reopen and reconsider play an essential role in USCIS adjudication process, lending an additional measure of quality assurance to USCIS decisions. In its analysis, the Ombudsman observed a marked variation in local policies at several USCIS offices. It also found that insufficient public information on the filing and adjudication of motion and related submissions may place unrepresented customers at a disadvantage in obtaining review of USCIS decisions that cannot be appealed to a higher administrative authority. This lack of procedural uniformity and public information adversely affects USCIS customers. Finally, the Ombudsman has provided two sets of recommendations to the USCIS to bring more uniformity to motions process and enhance customer service.
