NY Times Editorial Asks for Ending Widow Penalty

Echoing with the sentiments of many widow penalty victims and countless individuals and organizations that have voiced against the absurd and flawed federal law, recently the New York Times carried an editorial on ending widow penalty. The U.S. Citizenship and Immigration Services (USCIS) interpret the law as if a citizen spouse dies before the agency acts on his/her petition for a spouse’s green card – and if the marriage is less than 2 years old – the surviving foreign spouse automatically ceases to be a spouse. In plain terms, it means the petition dies with the petitioner and no exceptions can be made.
The editorial requested the Congress and the Department of Homeland Security to abolish “Widow Penalty” and opined that the law should protect immigrants who follow the rules.
